4. Information Sharing

We do not sell, rent, or share your personal information with third parties for marketing purposes.

With trusted service providers who perform functions on our behalf (e.g., payment processors, scheduling platforms like Housecall Pro).

Fix Force Repair – General Terms and Conditions of Service

By signing the Work Order or submitting payment to Fix Force Repair (hereinafter “we”, “our” and/or “Fix Force Repair”) you (hereinafter “you”, “your” and/or the “Customer”) agree and accept the terms of the Work Order and the following terms and conditions (“General Terms and Conditions of Service”).

The General Terms and Conditions of Service will apply to any services performed and/or goods provided by a 3rd party servicer referred by Fix Force Repair.It is your responsibility to familiarize yourself with these General Terms and Conditions of Service prior to allowing a 3rd party servicer referred by Fix Force Repair to commence work.Allowing a 3rd party servicer to commence service constitutes acceptance of the Work Order and the General Terms and Conditions of Service as detailed herein, even if you are not the owner of the subject property or appliances.

I. NON-REFUNDABLE SERVICE FEE

We charge a non-refundable service fee of $140 or $120 depending on the area of the service (the “Service Fee”) for all non-warranty visits to the Customer’s residence or business. The Service Fee will be quoted to you before our stay and must be paid before commencing the performance of diagnostic or other services. The Service Fee covers costs incurred by Fix Force Repair for advertisement and other expenses required to make an appointment with the 3rd party service technician. By accepting the Work Order, you acknowledge and agree:
a. There is no guarantee that 3rd party servicer will correctly assess the issue during the diagnostic service;b. To pay the Service Fee in full regardless of whether the 3rd party servicer performs recommended repairs or not, and regardless of whether the assessment is accurate; andc. That the Service Fee will be credited toward the cost to repair in the event that Customer agrees to have Fix Force Repair and the 3rd party servicer perform the recommended repair or replacement, and all repairs and replacements are completed in full.

When diagnosing, new breakdowns are possible that cannot be prevented. For example, you may have reported that your dishwasher was noisy, and when turned on by 3rd party servicer, the control board may break. Fix Force Repair takes no responsibility or liability for an appliance that incurs an additional breakdown during the diagnostic process.

We charge a cancellation fee of $40 if Customer cancels a diagnostic visit one hour before the timeframe of the appointment.

In case the diagnostic did not detect any problems, the Customer has the right to a second diagnostic for the same appliance and same problem within a 30-day period from the date of the appointment. The Service Fee must be paid in full.

II. PRICE QUOTE

The estimate section of the Work Order summarizes the costs for the parts and services we estimate are required to repair your appliance(s) (the “Estimate”). By accepting the Work Order, you acknowledge that you agree to the terms of the Estimate and the agreed-upon scope of work. If applicable, sales tax is included in the Estimate. You also acknowledge that the Estimate is an estimate and that the total repair cost may exceed the Estimate. If the total price exceeds the Estimate, then Fix Force Repair and the 3rd party servicer will not do the work unless it obtains consent from you. The Estimate is valid for 30 days from the sending date.

III. PAYMENT TERMS AND COLLECTION COSTS

Payment is due and will be collected upon completion of the services unless Fix Force Repair agrees in writing to different terms. Payment can be made by credit card, check, or online (Invoice Link). Any dishonored check or bank draft will be charged a processing fee of $50.

a. If payment was made by credit card, there will be a 3.5% credit card fee. In case of a refund by the credit card, this fee will be excluded from the refunded amount.

If paying by credit card, you authorize Fix Force Repair to charge the applicable card supplied to pay all fees. The card will remain on file until its expiration. You may revoke this authorization in writing, provided there is no outstanding debt.

You agree to pay for all returned or disputed payments. If we incur any fees, including attorney or collection service fees, to collect payment, you agree to reimburse us. Past due amounts shall bear 18% annual interest or the maximum allowed by law.

If repairs are approved, a deposit equal to the cost of parts and diagnostics (at minimum 50% of total invoice) is required.

If the Customer cancels after parts are ordered:
a. They may keep the part and pay full cost, including shipping and service fee.b. Or return the part, paying double shipping, a 20% restocking fee, and the service fee.Backorder parts cannot be returned and must be paid in full.

Used parts will be recycled unless Customer requests them in writing before the repair.

IV. LIMITED WARRANTY

If, after repair, an appliance fails its primary function (e.g., refrigerator doesn’t cool), notify us within 3 days via email. Refund applies to labor only if 3rd party servicer confirms the issue.

Warranty: labor – 90 days; parts – 1 year from service date.

a. Notify us in writing of any defects.b. One free recall visit within 90 days. If issue is confirmed as warranty, visit count resets. Otherwise, future visits are charged.c. Paid visit under warranty: if confirmed as warranty issue, we refund the visit fee.d. If we cannot visit within 10 business days, labor cost (not service fee) is refunded.e. To get a refund on defective parts, provide a report from another licensed company proving the defect, including photos.f. If the part is defective and reorderable, we’ll ship a replacement (up to 15 business days).g. If not available, we refund the original part cost.h. Refunds do not include used parts or shipping. All warranty claims require inspection by Fix Force Repair.

Warranty does not cover:
a. Commercial/industrial appliancesb. Cosmetic/non-functional partsc. Plumbing supply linesd. Appliances moved after servicee. Units with obsolete parts

No warranty honored if full payment is not received. All claims must be supported by documentation from a licensed third party.

THE WARRANTIES HEREIN ARE EXCLUSIVE AND REPLACE ALL OTHER WARRANTIES, EXPRESS OR IMPLIED. THEY ARE NON-TRANSFERABLE.

V. LIMITATION OF DAMAGES

Fix Force Repair is not responsible for incidental, special, or consequential damages. Our liability is limited to the amount paid by the Customer.

VI. CORE CHARGE

All electronic boards may have a “core charge.” If the part is not returned, the Customer must pay this fee (minimum $60). It is not included in the invoice.

VII. GOVERNING LAW AND DISPUTE RESOLUTION

All disputes are governed by California law.

If unresolved after 60 days, legal validity remains for rest of agreement even if one part is deemed unenforceable.

VIII. FLOOR AND FURNITURE PROTECTION

Optional protection: $150 for floor, $150 for furniture.

Must be requested in writing at time of Estimate approval.

Damage must be reported before technician leaves.

If confirmed, we may:a. Repair the damageb. Pay for your licensed contractor’s quotec. File claim with 3rd party servicer’s insurer

If not purchased or not reported on time — Fix Force Repair is not responsible.

IX. DAMAGE WAIVERS

By requesting service, you accept all waivers.

You release Fix Force Repair, its agents, and 3rd party servicers from all liability, even if negligent.

Waivers include but are not limited to:

Moving appliances (damage to flooring, cabinets, etc.)

Work involving water/gas (e.g., leaks, flooding)

Cooling failures (e.g., food spoilage, business losses)

Glass cooktop lifting (risk of cracking)

X. MISCELLANEOUS

These General Terms and Conditions of Service and each Work Order constitute the complete agreement (“Agreement”) between Fix Force Repair, 3rd party servicer, and the Customer, and supersede all prior or contemporaneous agreements or representations, written or oral.

Fix Force Repair is a doing business as (DBA) name of Liakh LLC, a California limited liability company.

Each term and provision of this Agreement that should by its sense and context survive any termination or expiration of this Agreement, shall so survive regardless of the cause and even if resulting from the material breach of either party to this Agreement.

If any provision or portion of this Agreement shall be rendered by applicable law or held by a court of competent jurisdiction to be illegal, invalid, or unenforceable, the remaining provisions or portions shall remain in full force and effect.
